A wrongful death lawsuit is unlike the typical personal injury case. It differs in that the actual victim/decedent is not bringing a claim. Most importantly, in wrongful death cases, the statute of limitations is only two years from the time of the decedent's death. Failure to file a timely lawsuit will result in the loss of the family's legal rights. In certain instances, wrongful death actions based on medical negligence/malpractice may possibly be extended beyond the two years.
